An employee relocation to India can involve several separate compliance steps, from visa selection and immigration registration to tax and payroll checks. The type of visa required depends on what the person will actually do and the entity that sponsors them. Foreign nationals must check whether FRRO or other immigration registration requirements apply to their visa and intended stay, along with the relevant deadlines.
Tax residency depends on the individual’s days in India and other applicable statutory tests. Payroll brings provident fund rules of its own. Tax efficiency is based on India’s own day count. Payroll brings provident fund rules of its own. Documentation and processing requirements can also vary according to the relevant authority and the employee’s circumstances.
The key is to identify the applicable requirements early, assign responsibility for each step and coordinate the work before the employee arrives.
Start with the visa, because everything else depends on it. India treats the Employment Visa and the Business Visa as two different categories.
The Employment Visa is for a professional taking a paid role with an Indian entity. That entity sponsors the application with a contract and its registration papers. The usual salary floor is USD 25,000 a year, with a few exceptions for specific roles.
The purpose of the Business Visa is for meetings and site visits. This type of visa doesn’t apply to employment. The correct category depends on the actual activities, the nature of the assignment and the applicable visa conditions. Regardless of the category, the role, pay, and duration should remain the same in all the documents.
| Criteria | Employment Visa | Business Visa |
|---|---|---|
| Purpose | Paid role with an Indian entity | Permitted business activities, including meetings and site visits |
| Paid employment | Permitted, subject to visa conditions | Does not authorise employment |
| Salary threshold | USD 25,000 a year, with exceptions | No Employment Visa salary threshold applies |
| FRRO registration | Subject to applicable registration requirements | Subject to the visa category, duration of stay and applicable exemptions |
Once the employee arrives, HR should confirm the applicable immigration registration requirements and deadlines. Certain foreign nationals holding Employment Visas valid for more than 180 days are generally required to register within 14 days of arrival, subject to the applicable rules and exemptions. The arrival date and visa conditions should be checked when calculating the deadline.
The procedures are mostly performed online, although a visit to the local office may be necessary in some cases. HR teams must get the names and passport details correctly captured the first time. This is because the registration record can affect extensions and exit formalities later.
Before the employee travels, confirm the required documents, identify the person responsible for registration and set reminders for each applicable deadline.
Small details matter when it comes to tax. India determines an individual’s tax residency using the number of days spent in the country and other applicable statutory conditions.
Under the general residence tests, an individual may qualify as an Indian tax resident after spending at least 182 days in India during the relevant tax year, or by meeting the 60-day test together with 365 days across the preceding four years. Exceptions and additional tests apply to certain individuals, including some Indian citizens and persons of Indian origin. Previous visits can therefore affect the assessment. The applicable provisions of the Income-tax Act, 2025, should be checked for the relevant tax year.
A Permanent Account Number (PAN) is required where applicable for Indian tax reporting, tax withholding and related compliance. HR and payroll teams should establish the employee’s PAN requirements before the first payroll cycle.
For provident fund, a worker whose home country has a social security agreement with India may qualify for an exemption from Indian social security contributions, subject to the applicable conditions and supporting documentation, such as a certificate of coverage. These agreements may also allow eligible periods of coverage to be aggregated for specified social security benefits.
Where an exemption does not apply, the contribution obligation must be assessed under the Indian provident fund rules for international workers, including the applicable wage definition and contribution requirements.
HR teams must review tax residency, payroll treatment and social security obligations everytime whenever a posting is extended or the employee’s circumstances change.
A Business Visa may appear suitable for a short assignment, particularly when the employee is travelling for meetings or site visits. However, problems arise when the employee’s actual activities fall outside the permitted scope of that visa.
But by that point, the start date is fixed, and the filing has to begin again, sometimes with questions about work already done. It’s a common slip.
Solution: The practical solution is to decide the category at the time of putting the offer forward. Evaluate the role, the salary, and the sponsoring entity. Well before the date of relocation, have the sponsor letter, contract, and company papers ready. This ensures that filing takes place as per the scheduled timeline, and there’s no rush after the employee has already left for India.
This gives the employer time to identify documentation gaps, check the applicable visa conditions and plan the application around the intended start date.
A registration deadline can be missed when immigration compliance is not included in the relocation checklist. Travel, accommodation arrangements and joining formalities can take up the employee’s first few days, leaving little time to gather documents and complete the required steps. A missed deadline may lead to compliance issues and complications with later immigration formalities.
Solution: Consider the relocation plan as a milestone, along with a named owner. Before the employee leaves the country, all the forms, photographs, and supporting documents should be in place. Set reminders for the date of arrival, and keep track of the progress when the registration is done. This ensures that the employee lands into a process that’s already on the move.
The HR team should also confirm the applicable deadline and retain evidence of submission and registration for future reference.
Tax residency requires a review of the employee’s days in India, previous visits and the statutory rules that apply to their circumstances. An earlier visit may affect the outcome, even if the current assignment is relatively short.
Even payroll adds to the complication. For a foreign national, the treatment for provident fund depends on the home country, social security agreements, and the paperwork on file. Mistakes usually show up after a few payslips are generated, and correcting them takes time.
Solution: Work it out before the move. Estimate the days in India with the home payroll team, check whether an agreement and detachment certificate apply, and apply for the PAN early.
This preparation helps the payroll team apply the appropriate treatment from the outset, subject to the documents, facts and approvals available.
Many employees get a checklist and good wishes. Then they spend their first weeks working out bank accounts, housing, and school admissions on their own, in a system they are not familiar with. Without local guidance, routine settling-in tasks can take longer and add pressure during the first weeks of an assignment.
Solution: A dedicated contact in India changes this situation. They handle or guide each step for the employee, and already know what each office expects. One of our clients, a European technology firm, moved its first senior hire to Bengaluru this way. The family had their housing and school sorted within the first few weeks.
A relocation plan can become difficult to manage when the time allowed for immigration approvals, document preparation and settling-in arrangements is too short. Visa processing times vary by application, while housing, schooling and banking arrangements depend on the employee’s circumstances and location. A fixed timeline should not be assumed to apply to every assignment.
Solution: Build the timeline around India right from the start. Run the visa filing and the housing search together, leave room for registration and bank setup, and fix the arrival date once approvals look certain. With this approach, every party involved can work at a steadier pace, and the employee gets enough time to pick a home and school with care.
For planning purposes, HR teams can use an indicative timeline based on the specific assignment, then revise it as applications progress. This gives the employee and the employer a clearer view of the tasks, deadlines and dependencies.
