Summary:

The UAE VAT amendments introduced in 2026 bring significant changes to input VAT recovery, including a five-year limit on excess recoverable tax and stricter supplier verification requirements. Businesses with historic VAT credit balances must review their records and assess eligibility under transitional provisions before 31 December 2026. This article highlights key regulatory changes, important deadlines and practical steps finance teams should take to protect eligible VAT recovery claims.
Businesses in the UAE holding unclaimed input VAT credits need to review their tax records before 31 December 2026. Changes to the UAE VAT Law have introduced a five-year limit for carrying forward excess recoverable tax, alongside transitional provisions for certain historic credit balances. Businesses must also review supplier documentation and payment records to support their input VAT recovery claims. With the deadline approaching, finance teams should identify eligible balances and take the necessary steps before the transitional period closes.

What changed, and when, in UAE VAT recovery 2026

Four crucial dates matter the most in UAE VAT recovery, and two of them are already behind us.
Effective date Key VAT change
1 January 2026 Five-year limit on excess recoverable VAT and restrictions on evasion-linked claims
1 October 2026 Supplier verification requirements and amendments to the VAT Executive Regulation take effect
31 December 2026 Deadline for eligible historic VAT credit balances under transitional relief
1 January 2028* Output-based apportionment for calendar-year businesses
*The statutory commencement is the first tax year beginning after 1 October 2027. 1 January 2028 applies to businesses following a calendar tax year.
The rules for the month of October come from Cabinet Decision 149 of 2026 VAT amendments that have been made to the Executive Regulation. On the other hand, the January rules are based on Decree-Law 16. This law also introduced the five-year cap. A different task is triggered by each date, which means the entire finance team can benefit from a single shared calendar.

Supplier due diligence and FTA Decision 13 of 2026

Since 1 October, every input VAT recovery UAE claim comes with a question. Does the business really know who it paid? FTA Decision 13 says the answer needs to be on file. This refers to the identity or incorporation details and the people authorized to act for the supplier.

The activities of the supplier should also be complemented by a business address. Red flags are covered in the review, too. This may include changing addresses, or hiring new staff every few months.

Larger suppliers get a deeper look. Above AED 375,000 in a twelve-month window, the file needs a verified bank account. This can be completed through a quick scan of public information. Payments by cash, through third parties, or into foreign accounts deserve a written explanation. A claim filed before these checks counts as knowing about any evasion link.

Five-year recovery limit

Excess input VAT used to roll forward year after year. The VAT five-year refund limit UAE businesses face now caps that at five years. The clock starts at the end of the tax period when the credit arose. Since 1st January 2026, this rule has also been incorporated for carrying forward.

There’s one last window for credits from the earliest VAT years, which extends till 31 December 2026. For businesses, tracing those balances involves reading returns from the first VAT year onward. It’s advisable to seek professional assistance from a VAT consultant in Dubai, who can sort live credits from expired ones. Then, the claim would be ready before the deadline.

Other changes to flag

Four smaller changes can still change your numbers.

  1. High-value cash payments will see restricted recovery under new Article 54(3). The threshold is still to come from a Ministerial Decision, and that’s why payment policies deserve a second look now.
  2. Residual input VAT will be apportioned by an output-based method from the first tax year starting after 1 October 2027. Businesses with mixed taxable and exempt supplies should run the numbers early.
  3. Inseparable components of one deal will be taxed as a single composite supply, following the principal component. Bundled contracts deserve a fresh read.
  4. Employee benefits get a wider exception that covers every free zone. Accommodation provided by an employer qualifies only where a MoHRE decision makes it mandatory.

Action checklist

Here’s a checklist that covers a major part of the exposure. At IMC, experienced consultants advise starting this month, and the first one carries the deadline.

  • Audit historic VAT credits from the first return onward and flag every balance near its expiry.
  • Build a supplier verification file that should include identity, location, bank details, and risk notes for major suppliers.
  • Review payment methods and move cash and third-party payments to traceable bank transfers.
  • Check how the new apportionment method will change the VAT you can recover on shared costs.
